Welcome to Smith Lake Watersports & Boat Rentals! Before renting our boats and equipment, please take a moment to review our Terms and Conditions. By booking with us, you agree to abide by these terms to ensure a safe and enjoyable experience.

**IMPORTANT** Upon completing your booking, you will promptly receive an invoice from PayPal via email for your rental. 
Please ensure the payment is made as soon as possible, as your reservation will not be confirmed until payment has been successfully processed.

1. Rental Policies

• Rental Times: Full-day rentals are from 9:00 AM to 5:00 PM.
• Deposit Requirement: 100% of the rental fee is required at the time of booking.
• Fuel: Boats must be returned with a full tank of gas. A fee of $10 per gallon will be charged for any refueling required.

2. Cancellation Policy

• 14 Days or More Before Rental: Receive a full refund.
• Within 14 Days of Rental: Forfeit 50% of the rental fee.
• Within 24 Hours or No Shows: Forfeit the entire rental fee.
• All cancellations must be submitted in writing via email to info@smithlakerentalboats.com. The time and date of the email received will determine the cancellation timing.

3. Late Returns

• Returning the watercraft after 5:00 PM will incur a charge of $100 every 15 minutes past the scheduled return time. Additional fees may apply if law enforcement or the Coast Guard is involved.

4. Damage and Liability

• Watercraft Damage: Renters are financially responsible for all damage occurring during their rental period.
  • Minimum Damage Charge: $500.
  • Propeller Damage Fee: Starts at $1,000.
• Lost Kill Tether or Assistance: A $250 towing fee applies for negligence requiring assistance.
• Beaching the Vessel: Strictly prohibited and will result in a $1,000 sanding and hull damage fee.

5. Cleaning Fee

• Excessive dirt on the watercraft upon return will result in a minimum cleaning fee of $150.

6. Safety Requirements and Prohibited Actions

• Life Vests: Swimmers must wear a U.S. Coast Guard-approved life vest at all times.
• Alcohol: Lewis Smith Lake is designated dry; no alcohol is allowed on boats, individuals, or any structures within Walker, Cullman, or Winston Counties.
• Drugs: The possession or use of illegal substances is strictly prohibited.
• Reckless Driving/DUI: Renters with previous citations for reckless driving or driving while under the influence in the past 3 years are not eligible to rent.
• Towing: Towing of any watercraft is prohibited under all circumstances.

7. Towable Equipment

• Renters acknowledge the inherent risks of using Towables (e.g., tubes, skis, boards) and voluntarily assume responsibility for their use. Renters must follow all safety instructions and are responsible for any damage to the equipment.

8. Release and Waiver of Liability

By booking with Smith Lake Watersports & Boat Rentals, renters release and waive all liability for any injuries, damages, or losses incurred while using our boats or equipment. Renters agree to indemnify and hold harmless Smith Lake Watersports & Boat Rentals from any claims resulting from their activities.

9. Governing Law

These Terms and Conditions are governed by the laws of the state of Alabama. Any disputes shall adhere to these governing laws.

10. Communication and Responsibility

It is the renter's responsibility to maintain communication with Smith Lake Watersports & Boat Rentals and ensure they understand all operational features of the watercraft. Staff will provide instructions before departure to ensure safety and compliance.
